The Electronic Signatures in Global and National Commerce Act (E-Sign) allows Banco Popular de Puerto Rico (we, us), after obtaining your consent, to provide, by electronic means, all notifications, disclosures, agreements and communications that are required by applicable laws and regulations to be provided in writing in connection with access to “Mi Crédito” platform (the “Platform”) and the rendering of “Mi Crédito” services (the “Services”). In addition, E-Sign also permits the general use of electronic records and signatures.
Consent. You understand and agree to receive, by electronic means as applicable, all documents, agreements, notifications, disclosures, terms and conditions, and communications that are required by applicable laws and regulations to be provided in writing and are related to the access to the Platform and the rendering of the Services (the “Communications”). In addition, you understand that the terms and conditions of this E-Sign Consent are being provided electronically and any acceptance by you of such terms and conditions constitutes your consent to them. By agreeing to this E-Sign Disclosure and Consent, you agree that all Communications delivered electronically by us, and all information, documents and authorizations submitted electronically by you, will be deemed given in “writing” and will have the same legal effect as if given in paper. Your consent will also permit the general use of electronic records and electronic signatures. Communications that you agree to receive electronically from us may include, but are not limited to:
Hardware and Software Requirements. Before you decide to agree to the E-Sign Consent, you should consider whether you have the required hardware and software capabilities to access and retain the Communications electronically. You will need to use the following computer software and hardware to access and retain the Communications: a PC or MAC compatible computer or other device capable of accessing the Internet, access to an e-mail account, and the latest version of any common Internet browser, such as Google Chrome, Safari or Microsoft Edge. Older versions for any given browser may or may not be supported, and support of any older version is at our sole discretion. You are responsible for obtaining, installing, maintaining and operating all hardware, software, and Internet access services necessary to receive electronic communications. You must have software such as Adobe Acrobat Reader® to access and retain Communications that are “PDF” files. Your access to this E-Sign Disclosure and Consent confirms that your hardware, software, and browser comply with these requirements.
Changes in Hardware and Software Requirements. If hardware and software requirements change while you are maintaining an active relationship with us and the change creates a material risk that you may not be able to access or retain Communications electronically, we will notify you of these changes. The continuation of use of the Platform after receiving notice of the changes is a reaffirmation of your consent.
Right to Receive a Paper Copy. You have the right to receive a paper copy of any Communications provided or made available electronically to you by us, but this may be subject to the imposition of charges. You will have the ability to download and print documents we send to you through the Platform during and immediately after the signing session. After the signing session is completed, if you wish to receive paper copies of any Communications, you may request it by communicating to the following telephone numbers: (787) 763-3055 or (844) 763-3055.
Right to Withdraw your Consent. You can withdraw your consent to receive future Communications electronically from us, at any time at no charge to you, by notifying us at the following phone numbers: (787) 763-3055 or (844) 763-3055. Your consent withdrawal shall be effective within a reasonable period of time after it is received by us. If you elect to receive Communications only in paper format, it may affect the speed at which we can complete certain steps in the transactions with you and delivering services to you because we will need first to send the required Communications to you in printed format, and then wait until we receive back from you your acknowledgment of your receipt of such paper Communications.
Change to Your Contact Information. You are responsible for updating and notifying us of any change in your contract information, including your email or mailing address. You may update such information directly in ‘Mi Crédito’ Platform or by calling: (787) 763-3055 or (844) 763-3055. You understand and agree that if we provide any electronic Communications, but you do not receive it because your e-mail or mailing address is incorrect, outdated or blocked by your internet service provider, we will still be deemed to have provided the electronic Communications to you. Any change to your e-mail address or other contact information will be effective only after we have received the change and have had a reasonable period of time of no less than one (1) business day to process the change.
Right to Terminate or Change Electronic Communications. We reserve the right, in our sole discretion and at any time, to terminate providing electronic Communications to you, or change the terms and conditions on which we provide electronic Communications. We will provide you with notice of any such termination or change as required by law.
Receipt of Communications. You are deemed to have received Communications from us when they are made available to you. It is your responsibility to log into the Platform regularly to stay updated with Communications. For Communications that we deem to be time sensitive, you will receive an e-mail from us, which may prompt you to log in to review any Communications.
E-Sign Acknowledgement. You acknowledge and accept that your consent to electronic Communications and the granting of authorizations and instructions will be made in connection with a transaction that affects the interstate commerce and is subject to E-Sign, and that you and us have the intention that E-Sign applies, in the greatest extent possible to validate our capacity to perform business with you by electronic means.
