“Mi Crédito” in Mi Banco Terms and Conditions

The use of “Mi Crédito” is subject to the following terms and conditions (the “Terms and Conditions”), which may be amended from time to time. YOU MUST ACCEPT THESE TERMS AND CONDITIONS BEFORE ACCESSING AND USING “MI CRÉDITO.”

As used in these Terms and Conditions, the terms “BPPR,” “we,” or “our” refer to Banco Popular de Puerto Rico, or any affiliate, agent, service provider, independent contractor, or assignee that, at our sole discretion, may be involved in providing services through “Mi Crédito,” including, but not limited to, Array US, Inc. The terms “you” or “your” refer to the individual using the “Mi Crédito” service.

By accessing or using “Mi Crédito,” you agree to these Terms and Conditions. We may amend or modify these Terms and Conditions at our sole discretion by providing written notice via email, postal mail, or by posting the updated Terms and Conditions in Mi Banco. If at any time you find these Terms and Conditions unacceptable, you may discontinue use of “Mi Crédito” by calling 844-763-3055 and requesting cancellation of the service. Such cancellation may take up to 10 days to be reflected. By continuing to use “Mi Crédito” after any amendment or modification, you agree to the updated terms.

General Description of the Service

“Mi Crédito” is a service that provides users with information compiled from their Experian credit reports (including VantageScore 3.0), credit score, credit score trend line, and factors that impact their credit.

Eligibility

To enroll in and use “Mi Crédito”, you must:

A. Be a resident of Puerto Rico or the United States Virgin Islands;
B. Be at least 21 years of age; and
C. Have sufficient credit history in your Experian credit file to generate a VantageScore 3.0 credit score and to provide credit report information. If Experian is unable to match you with a credit report or cannot obtain your VantageScore 3.0 credit score, you will not be able to use “Mi Crédito” until you have established sufficient credit history.

We reserve the right to deny your access to or use of “Mi Crédito” at any time.

Registration and Accurate Information

To access “Mi Crédito”, you must first accept the Mi Banco terms and conditions, under which you authorize BPPR to use your personal information to complete enrollment in the “Mi Crédito” service.

Authorization to Obtain and Use Your Credit Information

You understand that by clicking the “Accept and activate” button during the enrollment process, you are providing “written instructions,” in accordance with the Fair Credit Reporting Act, as amended, and other applicable laws, including state laws, authorizing BPPR and its service providers, which may include Array US, Inc., to obtain your credit score from Experian or another credit reporting agency on a monthly basis while you remain enrolled in “Mi Crédito.” 

This includes authorizing BPPR and its service providers to use your Social Security number to access your personal credit profile, verify your identity, and provide the “Mi Crédito” services.

Use of Your Credit Information

You understand that BPPR may use your credit information, as well as other information you provided before, during, or after enrollment, to:

  • Provide you with financial education, alerts, tools, and recommendations designed to help you improve your credit score, protect your credit, and support you in achieving your financial goals.

We will use information from your credit report to verify your identity without requiring further action from you. This information includes your name, Social Security number, date of birth, and address.

The score displayed on the “Mi Crédito” dashboard is your VantageScore 3.0 score, provided by Experian Information Solutions, Inc. Each of the three credit reporting agencies (Equifax, Inc., Experian Information Solutions, Inc., and TransUnion, LLC) uses a different scoring model and independently gathers data. These agencies obtain information from various sources (such as lenders, collection agencies, and court records) at different times, which may result in discrepancies among credit reports at any given time.

When we display your VantageScore 3.0 score in the “Mi Crédito” dashboard, this is done through a “soft credit inquiry,” which does not affect your credit score. If you choose to apply for credit products, the lender may obtain your credit report during the application process, which may impact your credit score. We do not guarantee that the information presented in “Mi Crédito,” including the credit score, will be the same information used or reviewed to evaluate your creditworthiness or eligibility for a specific product or service.

There may be instances when we are unable to obtain your Experian credit report due to credit alerts or freezes you have placed. In such cases, you are responsible for contacting the credit reporting agencies to remove the alert or freeze.

“Mi Crédito” Services

BPPR will offer “Mi Crédito” to eligible users. Eligible users will receive free access to their credit score, credit score trend, and factors impacting their credit. “Mi Crédito” services are described below:

1.     VantageScore 3.0 Credit Score

The credit score provided is your VantageScore 3.0, a model developed by the three major credit reporting agencies: Equifax, Inc., Experian Information Solutions, Inc., and TransUnion, LLC. The VantageScore 3.0 credit score predicts credit risk and measures the likelihood that an individual will repay debts on time. The scores provided through “Mi Crédito” are for informational purposes only. You may check your VantageScore 3.0 score through “Mi Crédito” as often as you wish without affecting your credit score.

“Mi Crédito” only displays information contained in your Experian credit report. Accounts that are not reported or that are later removed from your Experian report will not be reflected in your score. “Mi Crédito” does not maintain or modify your credit information. BPPR is not responsible for inaccurate results, including those resulting from incorrect, incomplete, or outdated information in your credit report.

2.     Credit Score Trend Line

This line displays your credit score history over time, allowing you to monitor changes in your score.

3.     Factors Impacting Your Credit Score

Users receive detailed information regarding the six (6) primary factors that impact their credit score, along with indicators of their current credit profile.

We do not guarantee that the information presented as part of the services offered through “Mi Crédito,” including the credit score, will be used or reviewed to evaluate your creditworthiness or eligibility, nor that you will be approved or denied credit by BPPR or any financial institution.

Security

As web browsers and/or mobile applications are updated over time, older versions of “Mi Crédito” may not work properly. You are responsible for updating your browser and Mi Banco mobile application as needed to ensure continued access to “Mi Crédito.” You should also understand that using a browser updated with security patches recommended by the provider is considered a security best practice.

You are responsible for the installation, maintenance, and operation of your computer, browser, mobile applications, and software. BPPR is not responsible for errors or failures resulting from malfunctioning of your computer, browser, or software. BPPR is also not responsible for computer viruses or other related problems that may be associated with the use of an online system.

New Features

We may, at any time and at our sole discretion, add new features to “Mi Crédito” or modify and/or remove existing features. We will notify you of any changes to features if we are legally required to do so, either via email or through the “Mi Crédito” tool in Mi Banco. By using any new or modified feature when available, you agree to be bound by the applicable rules and terms governing those features.

Termination of Access

We may terminate, suspend, or limit your access to “Mi Crédito,” in whole or in part, at any time and for any reason, including account inactivity, without prior notice. The obligations and liabilities of the parties incurred prior to the termination date shall survive termination of these Terms and Conditions for all purposes. We may establish additional eligibility criteria at our sole discretion.

Indemnification

You acknowledge and agree that you are responsible for your conduct while using “Mi Crédito” and agree to indemnify and hold harmless BPPR and its officers, directors, employees, and agents from any loss, damage, liability, cost, or expense of any kind incurred in connection with any third party or other claim related to your use of “Mi Crédito” or the use of “Mi Crédito” by any person using your account number or password, whether authorized or not, or due to your violation of these Terms and Conditions or the rights of any third party. Your obligations under this section shall survive termination of these Terms and Conditions and your termination of use of “Mi Crédito.”

Limitation of Liability

Except as expressly provided herein or where applicable law requires a different standard, neither BPPR, its partners or affiliates, nor Experian shall be liable for any loss, damage, or injury, nor for any direct, indirect, special, incidental, exemplary, or consequential damages, including lost profits, arising out of or related to the system, equipment, browser, and/or installation or maintenance thereof, access to or use of “Mi Crédito,” electronic or mechanical failures, the Internet, system or communication lines, telephone or other interconnection problems, errors, configuration issues, or delays involving intermediary computer or communication networks, data transmission facilities, or any other issues you may experience. Unless expressly stated otherwise in any applicable agreement, you understand and agree that use of “Mi Crédito” is at your own risk and that “Mi Crédito” and all information, products, and other content included in or accessible through the service are provided “as is,” “where is,” and “as available,” and are subject to change at any time without notice.

No Warranty

You acknowledge that BPPR, its partners, and Experian do not guarantee that “Mi Crédito” will be uninterrupted, timely, secure, or error free, unless otherwise stated. To the maximum extent permitted by law, BPPR, its partners, and Experian disclaim all representations, warranties, and conditions of any kind regarding “Mi Crédito” and all information, products, and other content included in or accessible through the service. No implied license is granted to you under these disclaimers.

Intellectual Property

“Mi Crédito” and any other trademarks, logos, and service marks displayed in Mi Banco (excluding those owned by Experian or Array US, Inc.) are registered trademarks of Popular, Inc., its affiliates or subsidiaries, or their respective third party owners. You agree not to alter, modify, or change these trademarks and not to use them for any purpose without our prior written consent.

Credit Dispute Resolution

If you identify inaccurate information in your credit report, please contact our Contact Center Monday through Friday from 8:00 a.m. to 5:00 p.m. at 787-763-3055 and/or toll free at 844-763-3055.

Governing Law

These Terms and Conditions shall be governed by the laws of the Commonwealth of Puerto Rico, without regard to conflict of law principles. You irrevocably and unconditionally submit to the jurisdiction and venue of the Puerto Rico courts and the United States District Court for the District of Puerto Rico.

Credit Repair

Neither BPPR nor Experian is a credit repair organization as defined under federal or state law, including the Credit Repair Organizations Act. Neither BPPR nor Experian provides “credit repair” services or advice or assistance related to “rebuilding” or “improving” your credit history, credit score, or credit record. Additionally, BPPR and Experian do not monitor specific events that may impact your credit information.

Your Right to Receive a Free Credit Report from AnnualCreditReport.com

“Mi Crédito” provides you with your VantageScore 3.0 credit score, related information, and other information from your credit report. However, it is important to know that under the Fair Credit Reporting Act, you are also entitled to receive a free credit report from each of the three national credit reporting agencies (Experian Information Solutions, Inc., TransUnion LLC, and Equifax, Inc.) once every twelve months.
